Election Rules Required
Requirement. Beginning July 1, 2006, all associations are required to adopt election rules that comply with Civil Code §1363.03 to include the following:
  • nomination procedures,

  • candidate qualifications,

  • a method of selecting independent third parties as inspectors of election,

  • rules regarding access to association media during campaigns,

  • rules regarding access to common area meeting space during campaigns,

  • secret balloting procedures, and

  • a ballot form.

Applicable Elections. As provided for in Civil Code §1363.03(b), applicable elections include:

  • election of directors,

  • removal of directors,

  • special assessments,

  • amendments to the CC&Rs and Bylaws, and

  • grants of exclusive use common areas.

Elections by Mail. If set up properly, elections can be done entirely through the mail.
