Elections Requiring Secret Balloting. Beginning July 1, 2006, all associations are required to adopt election rules that apply to elections requiring a vote by the membership, such as:
- election of directors
- removal of directors
- special assessments
- amendments to the CC&Rs and bylaws
- grants of exclusive use common areas
Format of Election Rules. All associations are required to adopt election rules that comply with Civil Code §1363.03 to include the following:
- nomination procedures
- candidate qualifications
- a method of selecting independent third parties as inspectors of election
- rules regarding access to association media during campaigns
- rules regarding access to common area meeting space during campaigns
- secret balloting procedures
- a ballot form
