QUESTION: Can an HOA request a copy of the rental agreement I have with a tenant??

ANSWER:
If your association's governing documents require that lease agreements be for a particular period of time (1-year is common), the only way it can verify compliance is to see a signed lease agreement.

Justification.
Associations have good reason to ban short term rentals: (i) buildings are damaged every time furniture is moved through the common areas, (ii) rules are ignored because short term renters lack commitment to the community--they're just passing through, and (iii) security suffers when there is a constant flow of new faces into and out of the development.


Redacted Information.
To show compliance with the restriction, the only relevant information is an executed agreement bearing the names of the parties, the date of the agreement, the lease term, and signatures. Accordingly, you can redact financial and personal information from the agreement before submitting it to the association.
