QUESTION: Do homeowners have the right to institute a newsletter of their own?
ANSWER: Yes, they have the right to publish their own newsletter. As I cautioned last week with owner-controlled websites, they cannot give the impression that the newsletter is an official publication of the association. Accordingly, owner-controlled newsletters cannot mislead members by using the association's name, i.e., the "Green Meadow Association Newsletter." In addition, the newsletters should add a disclaimer that the publication is not sponsored by nor does it speak for the association.
