RELATIVES ON THE BOARD

QUESTION: Our association is having a problem with too many relatives on the board. We were told that it is illegal to amend our bylaws to restrict relatives from being on the board.

ANSWER: The membership can amend the bylaws to restrict relatives (whether by blood or by marriage) from serving on the board at the same time. Such restrictions are legal and enforceable.

ASSISTANCE: Associations needing legal assistance can contact us. To stay current with issues affecting community associations, subscribe to the Davis-Stirling Newsletter.
