VERIFYING QUALIFICATIONS

QUESTION: We recently elected someone to our board who was not an owner. Isn't it the Inspector of Elections duty to verify a candidate's qualifications before putting their name on the ballot?

ANSWER: Verifying a candidate's qualifications is not one of the duties of Inspectors. However, Inspectors are given the power to hear and determine all challenges regarding voting issues. If an owner were to challenge the eligibility of a candidate, the Inspector could require the nominee to produce proof of ownership.
