LITIGATION DEFINED

The process of bringing and pursuing a lawsuit in a court of law so as to resolve a dispute or enforce a right before an impartial third party (a judge or jury).

Participants (plaintiffs and defendants) in lawsuits are called litigants. The plaintiff serves the defendant with a summons and complaint. The complaint describes the plaintiff's grievance as well as the remedy sought, such as damages or an order from the court preventing or compelling an act by the defendant, or a declaratory judgment to prevent future legal disputes.
